1. Introduction & Scope

These Terms and Conditions ("Terms") govern your access to and use of The Neon Store website (www.neonstore.co) and the purchase of products including custom-made and pre-made neon and LED signage (collectively, "Products"). By placing an order or using our website you agree to be bound by these Terms.

These Terms apply to customers worldwide, including customers in the United States, the European Union, the United Kingdom, Canada, Australia, the Netherlands, and all other international jurisdictions. Where local consumer protection laws provide you with rights that cannot be excluded or limited, nothing in these Terms affects those rights.

2. About Us

The Neon Store is a trading name operated by two entities:

• Bluestone Media Group Pty Ltd, incorporated in Australia. Registered address: 11/66 Clarence Street, Sydney, New South Wales 2000, Australia.

• Bluestone Media Group BV, incorporated in the Netherlands. Chamber of Commerce (KVK) number: 42036993. This entity serves as the contracting entity and data controller for customers based in the European Union and European Economic Area.

3. Products

3.1 Custom-Made Products

Many of our Products are manufactured to your individual specifications ("Custom Products"). By submitting a custom order you acknowledge that:

• Custom Products are produced specifically for you and cannot be resold or reused by us.

• You are solely responsible for the accuracy of any design, text, logo, or dimensions you submit.

• We will send a digital proof ("Design Proof") for your approval before production commences. Production begins only after you provide written approval.

• Changes requested after Design Proof approval may incur additional charges and production delays.

3.2 Pre-Made Products

Pre-made and stock Products are subject to availability. Images on our website are for illustrative purposes; minor variations in colour and finish may occur. Standard return and cancellation rights apply to pre-made Products.

3.3 Electrical Safety & Compliance

Our Products are designed to comply with applicable electrical safety standards. Each Product ships with a power adapter appropriate for the destination country. You are responsible for ensuring the Product is installed in accordance with the included instructions and applicable local electrical regulations.

4. Ordering & Contract Formation

Your order constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation email. We reserve the right to refuse or cancel any order where: (a) a product is out of stock; (b) there is a pricing error; (c) we are unable to verify payment; or (d) we reasonably suspect fraudulent activity.

Prices are displayed in the currency shown at checkout. Applicable taxes (VAT, GST, sales tax) will be calculated and shown at checkout where required by law.

5. Payment

We accept major credit and debit cards (Visa, Mastercard, American Express), PayPal, Shop Pay, and other methods displayed at checkout. Payment is processed securely via third-party payment providers. We do not store your full card details.

For Custom Products, full payment or a deposit (as specified at checkout) is required before production commences. 

6. Warranty

The Neon Store warrants all Products against defects in materials and workmanship for 12 months from the date of delivery ("Warranty Period"). This warranty does not cover:

• Damage caused by accident, misuse, improper installation, or modification.

• Normal wear and tear.

• Failure to follow our product instructions.

• Consumable parts such as power adapters, unless defective at delivery.

To make a warranty claim, contact us at info@neonstore.co with your order number, description of the fault, and photographs. This warranty gives you specific legal rights; you may also have additional rights under applicable law.

7. Consumer Rights by Region

Nothing in these Terms limits any statutory consumer rights you may have. Key regional rights include:

• Australia: Consumer guarantees under the Australian Consumer Law apply and cannot be excluded.

• United States: Implied warranties under applicable state law may apply. Residents of states with consumer-friendly warranty laws retain full statutory rights.

• European Union: You have a 14-day statutory right of withdrawal from distance contracts for pre-made goods (Custom Products are exempt under Directive 2011/83/EU). You also have a 2-year statutory guarantee. EU customers contract with Bluestone Media Group BV (KVK: 42036993).

• United Kingdom: Similar withdrawal rights apply under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.

• Canada: We comply with applicable provincial consumer protection legislation.

• Netherlands: Dutch consumers benefit from all rights under the Burgerlijk Wetboek (Civil Code) and applicable EU consumer protection directives as implemented in Dutch law.

8. Intellectual Property 

8.1 Our Content

All website content including text, images, graphics, logos, and software is owned by or licensed to Bluestone Media Group and is protected by copyright and trademark law. You may not reproduce or distribute our content without prior written consent.

8.2 Your Submitted Content

By submitting artwork or designs for a custom order, you warrant that you own or have full rights to use that content, and that it does not infringe any third party's intellectual property or other rights. You grant us a non-exclusive licence to use your submitted content solely for manufacturing your order. We accept no liability for infringement arising from content you submit.

9. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability to you shall not exceed the amount you paid for the Product giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, or loss of business.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia, except that:

• EU/EEA customers: contracts are governed by Dutch law. Disputes may be brought before the competent courts in Amsterdam, or referred to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

• UK customers: disputes may be referred to an approved ADR body or the courts of England and Wales.

• US customers: disputes shall be resolved by binding individual arbitration under AAA Consumer Arbitration Rules. CLASS ACTION WAIVER: proceedings shall be on an individual basis only, to the fullest extent permitted by law.

• All customers: we encourage you to contact us first at info@neonstore.co to resolve any dispute informally.

11. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy, constitute the entire agreement between the parties.

Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in full force.

Amendments: We may update these Terms at any time by posting the revised version on our website. Continued use after posting constitutes acceptance.
